Terms of Use

These terms are an agreement between you and Marinate — the developer who publishes the Marinate app on the App Store and Google Play (see section 8) — covering the app, the offline chart downloads it makes, and this website. By installing or using Marinate you accept them. If you do not accept them, do not use the app.

1. Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Marinate on devices you own or control, for your own navigation planning and situational awareness. The core app is free, requires no account, and stores your data (markers, routes, tracks, logbook, settings) on your device.

You may not:

• copy, sell, rent, or sublicense the app or Premium access;
• reverse engineer or modify the app except where law expressly permits it;
• use the app to build a competing chart or data service by bulk-extracting its data;
• circumvent Premium checks or redistribute Premium features.

Chart and data layers come from community and public sources — OpenStreetMap and OpenSeaMap (chart features), EMODnet (bathymetry), Open-Meteo (weather), aisstream.io (AIS, with your own key), and tide/current models. Each source keeps its own license and attribution terms, and your use of that data must respect them. GPX files you export are yours.

Our content and data

Marinate's own content belongs to us and is licensed to you only for personal use of the app. That includes the app and its code, design, icons and text; the reference tables, glossary, rules summaries and explanations; the places and marina directory as we compile and curate it; our map styles; and the map tiles, depth and satellite packs and other layers we process, host and serve. Except as the law or the licenses below allow, you may not, for any commercial or non-commercial purpose, without our written permission:

• copy, republish, or resell that content, or use it in another product or service;
• scrape, crawl, or bulk-download it, or access our tile and data servers other than through the app;
• use it to train, build, or improve another map, chart, or navigation dataset.

Open data stays open. Data we take from open sources remains under its original license, and nothing in these terms takes away any right that license gives you. In particular, map data from OpenStreetMap is © OpenStreetMap contributors and is available under the Open Database License (ODbL); you are free to obtain and reuse it from openstreetmap.org on those terms. Our restrictions apply to our own work and to our servers, not to your rights in the underlying open data.

2. Navigation-safety disclaimer

Marinate is an aid to situational awareness and passage planning. It is not a certified navigation system, and you must not rely on it as your only source of navigation information. When you use Marinate you agree that:

• you will carry and consult official charts and publications appropriate to your waters, as required by good seamanship and applicable law;
• you remain fully responsible for the safe navigation of your vessel, keeping a proper lookout, and complying with the collision regulations;
• GPS position, AIS targets, weather forecasts, tide predictions, and instrument data shown in the app can be delayed, degraded, or unavailable — offline or online;
• safety features such as the anchor alarm, MOB, shallow-water alarm, and CPA/TCPA collision alarm are aids only and depend on your device's sensors, connectivity, and battery — they can fail and must never replace watchkeeping;
• the skipper's judgement always overrides anything the app displays.

Automatically generated routes. Any route, track, or guidance produced by Marinate's route-planning tools is a preliminary suggestion useful for planning and must not be used for direct navigation. Generated routes are computed from indicative depth and coastline data, must be reviewed in full against official charts before use, and never account for all hazards, traffic, regulations, or conditions. Marinate is an ancillary aid designed to facilitate the use of official government charts, not to replace them; only official charts and notices to mariners contain all information needed for safe navigation.

YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.

Navigation should only be engaged in by persons trained and experienced in nautical navigation. The safety alarms (anchor drag, MOB, shallow water, collision) are conveniences layered on consumer hardware, not certified safety equipment; a phone that sleeps, loses fix, runs out of battery, or is silenced by the operating system will not alarm, and you must keep an independent watch as if the alarm did not exist.

3. Free tier, Premium, and billing

The core of Marinate is free forever: charts, GPS navigation, routes, markers, tracks, the logbook, and a 3-day weather forecast — together with the core safety alarms. One-tap MOB with auto-return and the anchor drag alarm are never paywalled. The CPA/TCPA collision alarm and the shallow-water alarm ship with the Premium layers they depend on (AIS traffic and SignalK instruments) and are never sold separately on top of them.

Marinate Premium adds depth shading and contours, the animated wind forecast, pressure isobars, the AIS overlay, SignalK instruments, track replay, and unlimited offline chart areas. Premium is offered as:

• a monthly subscription at $1.99/month;
• an annual subscription at $14.99/year.

Prices are shown in the store at purchase time and may vary by region and tax.

Store-managed billing

When you buy through the App Store or Google Play, billing is handled entirely by Apple or Google under their terms. That means:

• subscriptions renew automatically until cancelled;
• you can cancel anytime in your App Store or Google Play subscription settings — cancelling stops the next renewal, and you keep Premium until the end of the paid period;
• you can restore purchases on a new or reset device from within the app using the same store account;
• refunds are handled by the store under its refund policy — we cannot issue store refunds directly, but email us and we will help you navigate the process.

4. Your data and responsibilities

Marinate has no accounts and no tracking; your navigation data lives on your device. That puts you in charge of it: back up what matters (GPX export works for routes, tracks, and markers), and understand that deleting the app deletes its on-device data. Share links and GPX files you send to others contain whatever route or marker data you chose to share.

You are responsible for using the app lawfully — including data charges, any local rules on AIS or radio data use, and not entering content into notes or the pilot book that you have no right to use.

5. Warranty disclaimer and limits of liability

Marinate is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy of chart, weather, tide, AIS, or instrument data, and uninterrupted or error-free operation.

To the maximum extent permitted by law, Marinate and its developers are not liable for any indirect, incidental, special, or consequential damages — including grounding, collision, loss of vessel or equipment, injury, or loss of data — arising from your use of, or inability to use, the app. Our total liability for any claim is limited to the amount you paid us for Premium in the twelve months before the claim, or nothing if you use only the free tier.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law; and nothing limits any non-waivable rights you have as a consumer.

Time to bring claims. To the extent permitted by the law of your country of residence, any claim arising out of these terms or your use of Marinate must be brought within one (1) year after the events giving rise to it; this paragraph does not apply where such a limit is not permitted for consumers.

Your responsibility to others. You are responsible for claims by third parties (including your crew and passengers) that arise from your operation of a vessel while using Marinate, to the extent those claims result from your own navigation decisions rather than from a defect in the app.

6. Termination

You can stop using Marinate at any time by deleting the app. We may suspend or end your license if you materially breach these terms — for example, redistributing Premium or bulk-extracting data. Sections 2, 4, and 5 survive termination.

7. Changes to these terms

We may update these terms as the app evolves — for example, when new features, pricing, or data sources are introduced. The "Last updated" date at the top always reflects the current version, and material changes will be highlighted in the app or on this site before they take effect. Continuing to use Marinate after a change means you accept the updated terms; if you do not, stop using the app and cancel any subscription in your store settings.

8. Eligibility, governing law, and who we are

You must be old enough to form a binding contract in your country — and in any case at least 13 years old — to accept these terms. If you are a minor, a parent or guardian must accept them for you.

Marinate is an independently developed app. "Marinate", "we", and "us" in these terms mean the developer who publishes Marinate on the App Store and Google Play, reachable at support@getmarinate.com.

These terms, and any dispute arising from them or from your use of the app, are governed by the laws of the country in which the developer is established, without regard to conflict-of-law rules. If you use Marinate as a consumer, you additionally keep any protections — and any right to bring claims in your local courts — that the mandatory consumer law of your country of residence grants you.

App store terms. Where you obtained Marinate through the Apple App Store or Google Play, the store's own terms also apply, and Apple and its subsidiaries are third-party beneficiaries of this agreement with the right to enforce it against you. Product-related claims, maintenance and support are our responsibility, not the store's.
